Marlin Enterprises Limited T/A Pelagic Charters

I confirm that I am aware there are many hazards and substantial risks associated with this boat charter I am going on and I understand they include but are not limited to the following:

Drowning, on board injuries from boat movement, other boats, fishing and diving equipment, waves, marine creatures such as sharks, whales, marlin and even snapper with their strong jaws plus many more species.

If I enter the water I enter the water at my own risk and under my own management. I am aware that Marlin Enterprises T/A Pelagic Charters and related entities do run or manage any in water activities. I am aware of the substantial increased risks of being in the water.

By acknowledging this Agreement, I certify that I am fully aware of and expressly assume these and all other risks involved in making such a boat trip hereby confirm that I am an experienced diver with all the required certifications. I understand Marlin Enterprises Limited T/A Pelagic Charters and all related entities are not dive operators. I enter the water on my own accord and I understand the many risks of diving.

I, BY THIS INSTRUMENT, AGREE TO EXEMPT AND RELEASE ALL THE ABOVE LISTED ENTITIES AND/OR INDIVIDUALS FROM ALL LIABILITY AND RESPONSIBILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH, HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO, PRODUCT LIABILITY OR THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS NON-AGENCY DISCLOSURE AND ACKNOWLEDGMENT AGREEMENT AND LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING BOTH BEFORE I SIGNED BELOW ON BEHALF OF MYSELF AND MY HEIRS.
